1 SCOPE

1.1 These General Terms and Conditions apply in the version valid at the time of use exclusively for any use of the website robertniendorf.de (hereinafter referred to as "website"). Users can arrange appointments for consultations on the website. The appointment scheduling service is provided by the third-party provider simplybook.me. The use of the appointment scheduling service is subject exclusively to the terms of use of simplybook.me, which users must expressly agree to before sending an appointment.

4 RING CONFIGURATOR

Users can configure rings according to their own wishes using the ring configurator on the website. This service is provided by the third-party provider Albrecht Wörner GmbH, Marie-Curie-Ring 15, 63477 Maintal. The use of the ring configurator is subject exclusively to the terms of use of Albrecht Wörner GmbH, which users can view when using the ring configurator.

6 GENERAL LIABILITY PROVISIONS

6.1 The following exclusions and limitations of liability apply to the provider’s liability for damages, without prejudice to the other statutory requirements for claims.

6.2 The provider shall be liable without limitation if the cause of the damage is based on intent or gross negligence.

6.3 Furthermore, the provider is liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which enables the proper execution of the contract in the first place and on whose compliance the user regularly relies. In this case, however, the provider is only liable for foreseeable, contract-typical damage. The provider is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.

6.4 The above limitations of liability do not apply in the event of injury to life, body or health, for a defect after a guarantee has been given for the quality of the product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.

6.5 To the extent that the provider’s liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.

7 LIABILITY FOR OWN CONTENT AND THIRD PARTY CONTENT

7.1 Liability for own content: As a provider, we are liable for own content on these pages in accordance with Section 7 Para.1 German Telemedia Act (TMG). However, according to Sections 8 to 10 German Telemedia Act (TMG), as a provider we are not obligated to monitor submitted or stored information or to search for evidences that indicate illegal activities. Legal obligations to removing information or to blocking the use of information remain unchallenged. In this case, liability is only possible at the time of knowledge about a specific violation of law. If we become aware of such violations of law, we will remove this content immediately.

9.1 The place of jurisdiction and place of performance is the registered office of the provider if the user is a merchant, a legal entity under public law or a special fund under public law.

9.2 The contract language is German.

9.3 Platform of the European Commission for online dispute resolution (ODR) for consumers: https://ec.europa.eu/consumers/odr/ . We are not willing and not obliged to participate in a dispute resolution procedure before a consumer arbitration board.
